GENERAL TERMS AND CONDITIONS OF SALE (GTC)

1. PURPOSE AND SCOPE

These General Terms and Conditions of Sale (hereinafter “GTC”) govern all services offered by The Happy Hamlet, including in particular:

• The rental of furnished tourist accommodation for short private or family stays,
• Ancillary services such as catering, Finnish sauna, natural swimming pool, workshops, equipment rental or lending, or any other activity offered on site.

Any reservation implies the client’s full, unconditional and unreserved acceptance of these GTC. In the event of a contradiction with specific conditions, the latter shall prevail over these GTC.

These general terms define the rights and obligations of the parties in the context of distance booking. They govern all steps necessary for booking and for the follow-up of the reservation between the contracting parties. The client acknowledges having read and accepted these General Terms and Conditions of Sale and the sales conditions.


2. DEFINITIONS

Client: any natural or legal person making a reservation with The Happy Hamlet.
Private stay: rental of the furnished tourist accommodation for exclusive lodging use, for a fixed period.
Services: all services provided (accommodation, catering, equipment, activities, etc.).
Contract: document formalising the commitments between the parties, accompanied by payment of the deposit.
• The property can accommodate up to 15 sleeping places spread across five bedrooms. Beyond 10 people, a supplement per person applies in accordance with the quotation.
• The rental includes exclusive use of the buildings, terraces, garden, common room, fully equipped kitchen, sauna, and unheated natural pool, which is used under the client’s responsibility.
• It is not permitted to set up tents or any other means of sleeping on the property grounds.
• Clients undertake to respect the peace and quiet of the place, the neighbourhood, the surrounding nature and the facilities. Noisy parties, unauthorised fires and noise disturbances after 11:00 pm are prohibited unless written authorisation is granted.
• The Finnish sauna is wood-heated and its use is subject to prior explanation by the owner. The natural pool is unheated and at ambient temperature.


3. BOOKING PROCEDURE

Before any reservation, The Happy Hamlet provides all required legal and contractual information, including:

• Full identification of the company (company name, registered office, capital, RCS, managers);
• A precise description of the services offered, their duration, accommodation capacity, available equipment and conditions of use;
• The total price including taxes, or the method of price calculation, detailing any supplements or options;
• Payment, cancellation, refund and postponement conditions;
• Arrival and departure times, operating rules and safety rules;
• Any restrictions (noise, smoking, pool access, animals, parties).

3.1 Booking validation

A booking or quotation request may be made by email, telephone or online form.

The Happy Hamlet then sends the client a quotation/contract specifying the chosen service, dates, number of participants, total price, payment terms and specific conditions.

The GTC are provided at the time of the quotation or any booking request. A reservation becomes firm and final only once the following conditions are met:

  1. Signature of the contract or written validation (email) of the offer issued by The Happy Hamlet;
  2. Payment of a 30 % deposit of the total service amount;
  3. Receipt of written confirmation by email from The Happy Hamlet.

The balance is payable no later than 30 days before the arrival date for standard holiday rentals or family/friends events.

The reservation becomes firm and final upon receipt of the signed quotation/contract accompanied by payment of the stated deposit.

Without a signed return and deposit payment within the indicated deadlines, The Happy Hamlet cannot guarantee the availability of the property.

3.2 Payment methods

Prices are expressed in euros, all taxes included. They are calculated based on the selected services, number of participants, length of stay and season.

The quotation always specifies the total amount due, as well as any additional costs (cleaning, meals, equipment rental, catering services, accommodation tax).

Payments may be made by bank transfer or cheque. Bank details or IBAN are always specified on the invoice.

No discount will be granted for early payment.

In the event of non-payment by the due date, The Happy Hamlet reserves the right to cancel the reservation. Amounts already paid will be refunded minus a €100 administration fee.

The reservation is deemed formed upon receipt of a confirmation email. Prior to any reservation, the client undertakes to complete the requested information regarding the number of people, length of stay and ancillary activities. The client certifies the truthfulness and accuracy of the information provided. After final selection of the services to be booked, the booking procedure includes consultation and acceptance of the GTC and validation of the reservation by the client.


4. PRICES AND FINANCIAL CONDITIONS

Prices are expressed in euros, all taxes included. They are calculated based on the selected services, number of participants, length of stay and season. The quotation always specifies the total amount due and any additional charges (cleaning, meals, equipment rental, catering, accommodation tax).

Prices include:

• Accommodation under the conditions specified in the contract,
• Optional services (cleaning, activities, catering, etc.),
• Tourist tax collected on behalf of the local authority.

Prices do not include:

• Any deposits or specific charges mentioned in the contract.

Prices may change at any time, but the applicable prices are those in force at the time the reservation is confirmed.

4.1 Deposit

A 30 % deposit of the total amount including tax is required to validate the reservation. This deposit is refundable (see cancellation by the client).

4.2 Balance

The balance must be paid no later than 30 days before the arrival date. For reservations made less than 30 days before the service, full payment is required upon confirmation.

4.3 Payment methods

Payments may be made by bank transfer, cheque, or any other method specified in the quotation/contract.


5. INSURANCE

The client must be covered by holiday civil liability insurance. Proof of insurance (for clients residing in France, the home insurance certificate specifying this extension) must be provided at the time of booking to finalise the reservation. The issue date and coverage period must appear on the certificate. Without receipt of this document, the reservation is not possible; this requirement forms an integral part of the GTC.

The Happy Hamlet declines all responsibility in the event of:

• Theft, loss or damage to personal belongings of the client or their guests, or accidents occurring on the property outside secured areas;
• Damage resulting from inappropriate use of facilities or failure to follow safety instructions.

The client is responsible for any damage, loss or deterioration occurring in the rented premises and their dependencies. Repairs will be invoiced based on the corresponding estimate or invoice.

The establishment cannot be held responsible for non-performance or poor performance of the reservation in cases of force majeure, third-party actions or the client’s actions, including internet network unavailability, inability to access the website, external intrusion or computer viruses.


6. CANCELLATION AND MODIFICATION

6.1 Cancellation by the client

Any cancellation must be notified in writing (email). If clients fail to arrive without notice, no refund will be granted.

Refund conditions are as follows:

• More than 60 days before arrival: full refund of the deposit minus €100 administrative fees;
• Between 60 and 30 days before arrival: the deposit is retained by The Happy Hamlet;
• Less than 30 days before arrival: no refund will be made.

Any shortened stay or delayed arrival will not give rise to any refund.

6.2 Cancellation by The Happy Hamlet

In the event of force majeure (fire, flood, epidemic, administrative prohibition, etc.), The Happy Hamlet may cancel the reservation. In this case, the client will be fully refunded the sums paid, without any further compensation.

The client is reminded, in accordance with Article L.221-28 of the French Consumer Code, that they do not benefit from the right of withdrawal provided for in Article L.221-18. The conditions of sale of the booked rate specify the terms of cancellation and/or modification.


7. CONDITIONS SPECIFIC TO PRIVATE STAYS

The client undertakes to:

• Use the furnished accommodation peacefully and in accordance with its intended purpose;
• Not exceed the number of people indicated in the contract;
• Respect agreed arrival and departure times;
• Not organise parties, weddings or events without written authorisation.

Pets may be accepted under certain conditions. The mandatory cleaning fee is specified in the contract. Any additional cleaning services (kitchen, linen, outdoor areas, etc.) will be invoiced if the premises are not returned in an acceptable condition.

The tenant is responsible for the behaviour of all persons present during the stay and for any noise disturbances resulting in police intervention.

Responsible use and compliance with safety instructions are required.


8. MEALS AND ANCILLARY SERVICES

8.1 Catering services (breakfasts, brunches, aperitifs, group meals) are prepared on request and invoiced according to quotation.

8.2 The final number of guests must be confirmed no later than 7 days before the scheduled date. Any reduction after this deadline will not be refunded.

8.3 The client must report any allergies or dietary restrictions before the service.

The Happy Hamlet declines all responsibility in the event of failure to provide this information.


9. USE OF FACILITIES AND SAFETY

Occupants undertake to respect:

• Furniture, equipment and outdoor spaces;
• Safety rules, particularly around the unheated and unsupervised natural pool;
• Instructions for use of the wood-heated Finnish sauna.

The client expressly acknowledges that use of the natural pool is entirely at their own responsibility.

Children are under the exclusive supervision of their parents or guardians.


10. MAINTENANCE AND CLEANING

A mandatory cleaning fee applies to each stay, the amount of which is specified in the contract.

However, the client must:

• Leave the premises in a decent condition (clean dishes, emptied bins);
• Report any damage before departure.

Failure to comply may result in additional charges.


11. FORCE MAJEURE AND EXCEPTIONAL CIRCUMSTANCES

Force majeure refers to any external event beyond the parties’ control that is both unforeseeable and unavoidable, preventing either the client or the establishment from fulfilling all or part of their contractual obligations. Events recognised by French case law are considered force majeure.

Neither party may be held liable for non-performance due to force majeure. It is expressly agreed that force majeure suspends the mutual obligations of the parties, each bearing the costs resulting therefrom.

No party shall be held responsible for failure due to force majeure within the meaning of Article 1218 of the French Civil Code (natural disaster, strike, war, pandemic, etc.). If the service becomes impossible, The Happy Hamlet will propose a postponement date or refund the sums received, without further compensation.


12. ENVIRONMENTAL COMMITMENTS

12.1 The Happy Hamlet operates within a sustainable approach:

• Waste sorting and composting,
• Local and seasonal sourcing,
• Responsible management of water and energy,
• Use of ecological products,
• Preservation of the estate’s biodiversity.

12.2 The client undertakes to adopt behaviour consistent with these values: limiting water and electricity consumption, not littering, and preserving the tranquillity of the place.


13. PERSONAL DATA PROTECTION

Collected data (identity, contact details, booking information) are necessary for managing stays.

In accordance with the General Data Protection Regulation (GDPR), the client has the right to access, rectify and delete data by writing to:

Data (email and address) are retained for 10 years for accounting purposes and obligations.

Data are never shared with third parties without consent.


14. COMPLAINTS AND DISPUTES

These General Terms and Conditions are governed by the law of the country of the establishment, without prejudice to mandatory consumer protection provisions that may apply in the consumer’s country of residence.

Any complaint must be submitted in writing to The Happy Hamlet within 8 days after the end of the stay.

In the event of a dispute, the parties will seek an amicable solution before taking legal action. Failing agreement, the dispute will be brought before the Commercial Court of Montauban, which has exclusive jurisdiction.

Consumer clients may also resort free of charge to a consumer mediator in accordance with Article L.612-1 of the French Consumer Code.

The applicable law is French law.

If any clause of these GTC is declared null or unenforceable, the remaining clauses shall remain valid.


15. ACCEPTANCE

Validation of a reservation constitutes full and complete acceptance of these General Terms and Conditions of Sale, which the client acknowledges having read and understood.
