Service Provider:
The service provider is SARL HAPPY HAMLET, located at 1043 Route de la Laucarie, 82190 Fauroux, France. Share capital: 5000 EUR, SIRET number: 818 368 383 00019, registered at the Commercial Court of Montauban, France.

Article 1 – Preamble:
By paying the deposit or the full amount of the rental, the tenant agrees to comply with these general terms and conditions of sale (hereinafter referred to as “T&Cs”).

Article 2 – Purpose of the Rental:
The seasonal rental is reserved for the exclusive use of staying in furnished tourist accommodation. If the tenant intends to use the rental for any other purpose, they must inform the owner at the time of booking. The lessor reserves the right to amend these T&Cs.

Article 3 – Duration of Stay:
Under no circumstances can the tenant claim the right to extend their stay at Happy Hamlet after the agreed rental period.

Article 4 – Applicable T&Cs:
The reservation becomes effective once the tenant has paid a deposit of 30% of the total rental amount or the full payment.

The rental agreement between the parties may not be transferred, even partially, to third parties, whether individuals or legal entities, unless the lessor has given written consent. Any violation of this clause may result in immediate cancellation of the rental at the tenant’s expense, with the rental amount being permanently retained by the lessor.

Article 5 – Payment of the Balance:
The balance of the rental must be paid 15 days before the arrival date. In the event of non-payment, the reservation will be considered “canceled by the tenant.”

Article 6 – Cancellation by the Tenant:
Any cancellation must be notified by email to the lessor of Happy Hamlet.

For reservations canceled at least 60 days before arrival, 50% of the booking fees will be refunded. Reservations canceled later will not be eligible for any refund.

If the tenant fails to show up within 24 hours of the specified arrival date, the lessor may make the property available to others. Any sums already paid will remain with the lessor.

If the stay is cut short, the rental price will remain with the lessor, and no refund will be issued.

Article 7 – Cancellation by the Lessor:
The lessor will refund the tenant the full amount of the sums paid.

Article 8 – Inventory and Condition of Property:
An inventory will be carried out jointly upon the tenant’s arrival and at departure. This inventory will serve as the sole reference in case of any dispute regarding the condition of the property.

The property must be clean upon the tenant’s arrival, as noted in the inventory. The tenant is responsible for cleaning during their stay. The cost of cleaning at the end of the rental is included in the original invoice.

Article 9 – Security Deposit:
Upon arrival, the tenant must provide a security deposit equivalent to 30% of the rental amount, in the form of a check or another method. After the final inventory check, the deposit will be refunded, minus any costs for damage repairs if necessary.

If the tenant leaves early, preventing the final inventory check on the departure day, the security deposit will be returned by the lessor within one week.

Article 10 – Use of the Property:
The tenant must ensure the peaceful enjoyment of the property and use it in accordance with its intended purpose.

Article 11 – Capacity:
Happy Hamlet is intended for a maximum capacity of 15 sleeping arrangements and can accommodate up to 70 people for events. If the number of tenants exceeds the agreed number at the time of booking, the lessor may refuse the additional guests.

Article 12 – Pets:
Pets are allowed on a case-by-case basis with the lessor’s consent. If the tenant fails to comply with this agreement, the lessor may refuse the stay, and no refund will be issued.

Article 13 – Insurance:
The tenant is responsible for any damages caused during their stay. They must have vacation insurance coverage for various risks. A copy must be sent by email after the reservation is confirmed.

Article 14 – Disputes:
Any claims related to the condition of the property or discrepancies in the description of the rental must be resolved amicably. If no resolution is reached, the Commercial Court of Montauban may be called upon, as it is the sole authority for such disputes.
